Did you know that Resolution No. 254/2025/QH15 introduces targeted solutions to unlock key challenges in the implementation of the Law on Land?

The Law on Land 2024 was expected to introduce comprehensive reforms to land administration and land use management in Vietnam. However, since its effective date on 1 August 2024, the implementation process has exposed significant practical challenges, particularly in land recovery and site clearance, land allocation and change of land use purpose, land pricing mechanisms, calculation of land use levy and land rent, as well as land registration and issuance of land use right certificates. These bottlenecks have resulted in prolonged disputes, project delays and inefficiencies in land resource utilisation, adversely affecting the real estate market and socio-economic development.


To address these issues without amending the Land on Law itself, the National Assembly promulgated Resolution No. 254/2025/QH15 dated 11 December 2025 (effective mainly from 1 January 2026), introducing specific mechanisms and exceptional policies to unblock implementation obstacles (“Resolution 254”). These mechanisms are further elaborated in Decree No. 49/2026/ND-CP (“Decree 49/2026”) and Decree No. 50/2026/ND-CP (“Decree 50/2026”), both issued on 31 January 2026. Together, these decrees amend and supplement a number of existing guiding regulations, while also providing clearer formulas, transitional arrangements, and greater decentralisation of authority to competent agencies.
